5. Fees and Payments

You agree to pay all fees and charges associated with your use of the Services in accordance with the pricing and billing terms presented to you.

All trademarks, logos, and service marks displayed on the Services are the property of their respective owners. You may not use any of these without our prior written consent or the consent of the applicable owner.
7. User Content
You may be able to submit, upload, or transmit content (including text, data, images, or other materials) through the Services (“User Content”).
You retain any ownership rights you have in your User Content.
By submitting User Content, you grant BookedTrust a worldwide, non‑exclusive, royalty‑free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with operating and providing the Services.
You represent and warrant that:
You have all rights necessary to grant this license.
Your User Content does not infringe or violate any third‑party rights or any law.
We may, but are not obligated to, review, monitor, or remove User Content that we determine in our sole discretion violates these Terms or is otherwise objectionable.
8. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information and our practices regarding SMS/text messaging programs.
By using the Services, you acknowledge that you have read and understand our Privacy Policy and agree to its terms.

The Services may contain links to third‑party websites, applications, products, or services that are not owned or controlled by BookedTrust.
We do not endorse or assume responsibility for any third‑party properties or their content, products, or services.

To the maximum extent permitted by law:
The Services are provided on an “as‑is” and “as‑available” basis, without warranties of any kind, whether express or implied.
We do not warrant that the Services will be uninterrupted, secure, or free of errors, viruses, or other harmful components.
We do not make any guarantees about the accuracy, completeness, or reliability of any content or information provided through the Services.
You use the Services at your own risk.
11. Limitation of Liability
To the fullest extent permitted by law:
BookedTrust and its affiliates, officers, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Services, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or relating to the Services or these Terms will not exceed the amount you have paid to us for the Services during the three (3) months preceding the event giving rise to the claim, or, if no such payments have been made, one hundred U.S. dollars (USD 100).
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

Your violation of any rights of another person or entity.
Your User Content.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us in asserting any available defenses.

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice.

You and BookedTrust agree to submit to the personal jurisdiction of such courts, where applicable.
16. Miscellaneous
Entire Agreement: These Terms, together with any additional terms or policies referenced herein (including our Privacy Policy), constitute the entire agreement between you and BookedTrust regarding the Services.
Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms without restriction.
